ASA rules against The Investors' Guide |

The Advertising Standards Authority (ASA) has ruled in favour of Profile's Stock Exchange Handbook (now Profile's JSE Handbook) following a complaint lodged by Profile against The Investors' Guide (TIG). In a wide-ranging ruling, the ASA directorate upheld the complaint that TIG misleads the market about the superior circulation of Profile's JSE Handbook. A complaint about the misleading use of a comparative review of JSE reference books by David Bullard was also upheld. The ASA also found TIG guilty of negative marketing, and the directorate's ruling points out that "products should be promoted on their own merits and not on the demerits of competitive products". The ASA upheld the complaint that TIG does not have the support it claims from listed companies. TIG originally boasted support of over 90% of JSE-listed companies, but the ASA ruling suggests that less than 25% of listed companies actually support the book. The ASA found that TIG was unable to substantiate any of eight claims likely to mislead consumers and failed to submit any evidence in substantiation of the claims made in its advertising. The Investors' Guide has not appealed the ruling. |
